Terms of purchase
1. Introduction
These general terms and conditions (the “Terms”) apply to the use of digital services provided by Atom Agency AB via the Atom Access platform. By registering and using the Platform, you agree to these Terms and Conditions.
2. The services
Atom Access is a digital platform that offers a wide range of services for registered users. The services can be purchased through two different arrangements:
Creative Flex
Creative Flex is a flexible option where the user replenishes his account with credits and orders work himself if necessary. Credits can be used for services in areas such as strategy, branding, design, marketing, web, analytics, SEO and security.
Creative Access
Creative Access is a subscription based on a more proactive approach. Here we tailor solutions and work continuously to achieve set goals based on the specific needs and objectives of the customer.

3. Prices and payment
Awards
All prices in texts are stated in SEK and exclude VAT where applicable to companies. When purchasing services, prices including VAT are displayed. Current prices for the services can be found on the platform.
Payment
Payment is made through Stripe, a secure solution for credit or debit cards. The amount will be charged in advance at the time of purchase.
Receipt
An electronic receipt will be automatically sent to the email address registered at the time of purchase. The receipt contains details of the purchase, including amounts both excluding and including VAT.
4. Right of withdrawal
You as a consumer have the right to cancel your purchase within 14 days from the date the purchase was made, according to the Act on Distance Contracts and Off-premises Agreements.
If the service has begun to be used during this period, for example by starting work or using credits, only the part that has not been used can be refunded.
If you wish to exercise your right of withdrawal, please notify us in writing by email at info@atomagency.se.
5. Availability and support
Atom Agency AB strives to keep the services available without interruption. Support and questions are handled during business hours, Monday to Friday 09:00 — 17:00 via our switchboard or via a created case on the portal.
Services performed through credits or subscriptions are managed by our employees and are planned to be delivered within a reasonable and agreed time. Certain circumstances, such as illness or unexpected resource constraints, can affect delivery times. In such situations, we notify you as a customer and work to minimize the impact.
We are not responsible for interruptions or delays due to force majeure or technical problems beyond our control.

6th. Intellectual property rights
Materials and services produced by Atom Agency AB for the customer, including design, development of technical platforms, video production and the like, are fully owned by the customer upon completion and payment of the assignment.
Any rights acquired by Atom Agency AB on behalf of the customer, such as licensed images or software licenses, are specified separately and deducted from the customer's credits or billed as an additional cost, upon agreement with the customer.
If licenses or other services are handled and paid for by Atom Agency AB during the cooperation, the customer may, upon termination of the cooperation, either choose to buy out these rights or sign their own licenses for continued use.
7. Privacy and personal data
Personal data is processed in accordance with applicable data protection legislation, including GDPR. The data you enter within the Atom Access platform is fully editable via your portal login. More information on how we handle personal data can be found in our privacy policy.
8. Limitation of Liability
Atom Agency AB works to deliver marketing services of high quality and with the utmost care. However, we cannot guarantee specific results or outcomes from marketing activities, such as advertising through Google Ads, when these are affected by factors beyond our control, such as market conditions or third-party platforms.
We are not responsible for any indirect damage or loss of data that may occur in connection with the use of our services. Atom Agency AB is also not responsible for financial consequences that are beyond our control, but we always work to minimize risks and maximize the value of the services we provide.
9. Force majeure
Atom Agency AB is not responsible for delays or failure to fulfill its obligations if this is due to circumstances beyond our control, such as natural disasters, wars, pandemics or other extraordinary events.
10. Changes to the Terms
In order to ensure that our services continue to be relevant and adapted to the needs of our customers, Atom Agency AB may occasionally need to review and update these terms and conditions.
Any changes will be notified by email and will take effect 30 days after the information has been served. The updated terms and conditions are always available in the Atom Access platform and can be saved by you as a customer. The date of last update is clearly stated on each occasion.
11. Dispute Resolution
This Agreement is governed by Swedish law, with the exception of rules and principles of international private and procedural law. Disputes arising in connection with the Agreement shall primarily be resolved through dialogue between the Parties. If a solution cannot be reached, the dispute shall be decided by the Swedish General Court, with Malmö District Court as the first instance.

Atom Access offers two main plans to meet the different needs of its customers: Creative Flex and Creative Access. For more information on these, visit our help center.
Creative Flex (FLEX Credits)
Creative Flex is a flexible solution where the customer is responsible for reviewing their needs and ordering works through our portal when the time comes.
Creative Access (PLUS Credits)
Creative Access is a subscription-based solution where we work proactively as an external marketing team for the customer.
